Court Rules In Favor Of Company In Case Involving Parts Containing Asbestos

Philip Royce May v. Air & Liquid Systems Corp

According to this Legal News Line article, Philip Royce May’s naval career spanned 20 years and began in 1956. May worked on naval ships as a machinist and was responsible for replacing gaskets and packing in the vessel’s steam pumps. Mr. May’s naval career ended in 1976 but he was diagnosed with mesothelioma over 3 decades later in 2012.

Mr. May filed suit under the notion that Air & Liquid systems corp had a duty to warn about the potential dangers of asbestos-laden replacements. The court ruled in favor of Air & Liquid Systems because under Maryland law, forseeability alone does not suffice enough establish to a duty.
